General Terms and Conditions of Sale
Article 1 – Scope of Application
These General Terms and Conditions of Sale (hereinafter “GTCS”) govern the sales of products offered by the individual micro-enterprise Debby Meury (hereinafter the “Company”) to any buyer (hereinafter the “Buyer”). Any order implies the Buyer’s full and unreserved acceptance of these GTCS.

Article 2 – Products and Characteristics
The Company offers used or refurbished items (furniture, decorative objects, etc.) that may show signs of prior use or wear. Each product is described as precisely as possible with photos, dimensions, and descriptions.
The information provided (text, images, colors) is non-contractual. Variations or minor errors may occur without engaging the Company’s liability.
Products are sold “as is” and may have imperfections consistent with their age and usage history.
Article 3 – Prices, Shipping Costs, and Payment
3.1. Prices
Prices are listed in euros (€), including VAT when applicable or with the note “VAT not applicable” under Article 293B of the French General Tax Code if applicable.
Prices do not include shipping costs, unless specifically mentioned. Shipping costs remain at the Buyer’s expense.
3.2. Shipping Costs
Shipping costs are either calculated or set at a flat rate, depending on the chosen shipping method (Colissimo, Mondial Relay, specialized carrier, etc.).
For deliveries outside Mainland France, the Buyer should contact the Company to determine the applicable shipping methods and rates.
3.3. Payment Methods
Payment must be made in full at the time of order, through one of the accepted methods: bank transfer, PayPal, credit card (via a secure platform), etc. (adapt based on actual payment options).
An invoice can be provided upon the Buyer’s request.
Article 4 – Order Process and Delivery
4.1. Order Confirmation
Every order must be confirmed by the Company (via email or another communication channel).
The Company reserves the right to refuse or cancel an order if the product is no longer available or in the event of a dispute with the Buyer.
4.2. Shipping Time
The Company aims to ship orders within [e.g., 2 to 7 business days] from receiving full payment.
Actual delivery times vary depending on the carrier and destination. The Company shall not be held liable for any delays caused by the carrier.
4.3. Checking the Package
It is the Buyer’s responsibility to check the condition of the parcel upon receipt, in the presence of the delivery person or postal worker.
In case of damage:
Refuse the parcel, noting “Parcel refused due to damage” on the delivery slip,
Or record any specific reservations on the delivery note.
The Company shall not be liable for damages caused during transport but will assist the Buyer in any claims with the carrier.
Article 5 – Warranty and Liability
5.1. Used Products
The Company’s items are primarily second-hand or reconditioned and can show signs of wear.
They are sold “as is” and no contractual warranty applies, except for the legal warranties under French law (see below).
5.2. Legal Warranty
Under French law, the Buyer benefits from the legal warranty of conformity (Articles L.217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).
Any claim under these warranties must be notified in writing (by email or letter) within the legal time limits.
5.3. Limitation of Liability
The Company cannot be held liable for misuse of the products by the Buyer or for non-compliance with the regulations of the destination country.
The Company is likewise not responsible for any damage related to use of the internet (service interruption, external intrusion, viruses, etc.).
Article 6 – Right of Withdrawal
6.1. Statutory Period
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Buyer has a 14-day period from receiving the products to exercise the right of withdrawal, without giving any reason or incurring any penalty.
6.2. Withdrawal Procedure
The Buyer must inform the Company of the decision to withdraw (email to contact@debbymeury.com or by mail) before the 14-day period expires.
The products must be returned in their original condition and complete (packaging, accessories, etc.) within 14 days after notifying the Company of the withdrawal.
Return shipping costs are borne by the Buyer. Returns with cash on delivery are not accepted.
6.3. Refund
The Company will refund all sums paid (including initial shipping fees) no later than 14 days from the date it is informed of the Buyer’s decision to withdraw and upon receipt of the returned products or proof of their shipment (whichever is earlier).
Refunds are made using the same payment method used for the initial transaction, unless otherwise agreed.
Article 7 – Personal Data
The Company may collect personal data (name, address, email) to manage orders and invoicing.
These data are processed in accordance with France’s Data Protection Act No. 78-17 of January 6, 1978 (“Informatique et Libertés”) and the General Data Protection Regulation (GDPR).
The Buyer has the right to access, rectify, and object to the use of personal data. Requests should be sent to contact@debbymeury.com.
Article 8 – Intellectual Property
All materials published by the Company (texts, images, logos, etc.) are protected by intellectual property law.
Any reproduction, even partial, is strictly prohibited without prior written authorization from the Company.
Article 9 – Disputes and Governing Law
In the event of a dispute, the Buyer and the Company agree to seek an amicable solution before any legal action.
Failing an amicable resolution, jurisdiction shall be vested in the competent French courts of the Company’s registered office or the defendant’s place of residence, according to applicable procedure rules.
These GTCS are governed by and construed in accordance with French law.
Article 10 – Archiving and Proof
The Company shall archive purchase orders and invoices on a reliable, durable medium in compliance with Article 1348 of the French Civil Code.
The Company’s computerized records are deemed by all parties as evidence of communications, orders, payments, and transactions between the parties.
